Welcome to David Vanclieaf Photographer. By accessing this website, purchasing artwork, booking photography services, or otherwise using my services, you agree to the following Terms & Conditions.
Fine Art Prints & Artwork
All fine art prints, open editions, limited editions, framed artwork and other photographic products are produced with care and may be made or prepared specifically for each order.
Colours, brightness, contrast and appearance may vary slightly between the image displayed on a digital screen and the finished physical print. Differences in monitors, printing materials, paper texture, framing and lighting are normal and are not considered defects.
Print dimensions are approximate and may vary slightly depending on the artwork, border, mounting or finishing method.
Limited Editions
Artwork identified as a Limited Edition is produced only within the stated edition size for that particular edition.
Where applicable, limited-edition prints may be individually signed and numbered and accompanied by a Certificate of Authenticity.
Artist proofs, exhibition proofs or other clearly identified proofs may exist separately from the numbered edition where disclosed.
Once a numbered limited edition has been exhausted, no additional numbered prints from that same edition will be produced.
Different sizes, formats, materials or separately identified editions of an artwork may be offered unless the product description specifically states otherwise.
Open Editions
Open-edition prints are not individually limited to a predetermined number and may remain available, be discontinued or return to the collection at the discretion of David Vanclieaf Photographer.
Availability of an open edition does not guarantee that a particular image, size, paper or format will remain available permanently.
Final Sale, Returns & Refunds
All artwork, fine art prints, limited editions, open editions, framed pieces, custom orders and made-to-order products are final sale. NO REFUNDS
I do not accept returns, exchanges, refunds, or cancellations simply because a customer changes their mind, chooses an incorrect size, no longer wants the artwork, or determines that the artwork does not suit their space.
This policy does not limit any rights or remedies that cannot legally be excluded under applicable law.
If an order arrives damaged, defective, or materially different from what was ordered, please contact David Vanclieaf Photographer promptly after delivery with photographs of the product, packaging and shipping damage.
Where appropriate, I will work with the customer and shipping provider to determine a suitable remedy.
Please review your artwork, size, framing and shipping information carefully before completing your purchase.
Custom & Oversized Prints
Custom sizes, including statement-size artwork, may be available by request.
Custom orders require approval of specifications and pricing before production. Once production has begun, custom orders cannot normally be changed or cancelled.
All custom and oversized artwork is final sale except where otherwise required by law.
Shipping & Delivery
Shipping and delivery estimates are provided as estimates only and are not guaranteed.
Production and delivery times may vary depending on print size, framing, availability of materials, destination, weather, courier delays and other circumstances outside my reasonable control.
David Vanclieaf Photographer is not responsible for delays caused by postal or courier services.
Customers are responsible for providing a complete and accurate delivery address.
Additional shipping charges may apply to oversized artwork, remote locations or special delivery requirements.
Copyright & Intellectual Property
Purchasing a photograph or fine-art print does not transfer copyright or intellectual-property rights to the purchaser.
Unless otherwise expressly agreed in writing, all photographs, artwork, images, designs, website content and other creative works displayed or sold by David Vanclieaf Photographer remain protected by copyright and are the intellectual property of David Vanclieaf Photographer / David Vanclieaf.
Artwork purchased from this website is intended for personal display and enjoyment unless a separate written commercial licence has been granted.
Images and artwork may not be copied, scanned, photographed for reproduction, reproduced, altered, distributed, resold as reproductions, used commercially, used in advertising, incorporated into another product, used to train or develop artificial-intelligence systems, or otherwise exploited without prior written permission.
Ownership of a physical print does not constitute ownership of the underlying image or copyright.
Website Images
Images appearing on this website may not be downloaded, copied, reproduced, screenshotted for commercial use, published or distributed without permission.
Sharing a link to my website or social-media content through normal platform sharing functions is welcome, provided the work is not altered and authorship is not misrepresented.
REAL ESTATE PHOTOGRAPHY TERMS
Booking & Payment
Real estate photography services are subject to availability and confirmation.
Pricing is based on the selected package, property requirements, location and any additional services requested.
Additional charges may apply for travel, unusually large properties, extensive acreage, special editing, rush delivery, additional visits or services outside the original scope.
Payment terms will be communicated at booking or invoicing.
Property Preparation
The property should be clean, staged and ready to photograph before the scheduled appointment.
The photographer is not responsible for cleaning, staging, moving heavy furniture, extensive rearranging of personal belongings or preparing the property.
Reasonable minor adjustments may be made where practical, but significant preparation may result in additional charges or reduced photography time.
Cancellations & Rescheduling
Clients should provide as much notice as reasonably possible when cancelling or rescheduling.
A cancellation or rescheduling fee may apply when insufficient notice is provided, particularly where travel has begun, the appointment time cannot reasonably be rebooked, or expenses have already been incurred.
Weather-dependent services, particularly aerial/drone photography, may be rescheduled when conditions are unsafe or unsuitable.
Safety and legal flight requirements take priority over completing aerial photography on a particular date.
Image Delivery
Delivery times are estimates unless a specific turnaround has been agreed upon in writing.
Images are professionally selected and edited according to the style and standards of David Vanclieaf Photographer.
RAW or unedited files are not provided unless specifically agreed to in writing.
Real Estate Image Licence
Unless otherwise agreed in writing, real estate photography is licensed to the commissioning client for the marketing and promotion of the specific property for which the photographs were created.
This may include MLS listings, brokerage websites, social media, property websites, digital advertising and related property-marketing materials during the applicable listing or marketing period.
Copyright remains with David Vanclieaf Photographer.
Payment for photography services does not constitute a transfer of copyright.
Images may not be sold, transferred, sublicensed or provided to another realtor, brokerage, homeowner, builder, designer, contractor, publication or other third party for unrelated or future commercial use without permission.
If another party wishes to use the photographs, a separate licence may be required.
Image Alteration
Clients should not substantially alter, manipulate or apply filters to delivered photographs in a manner that misrepresents the photographer's work.
Normal resizing and cropping required by MLS platforms and social-media platforms is permitted.
Property Accuracy
Photography is intended to present the property professionally while maintaining a reasonable representation of the property.
David Vanclieaf Photographer will not intentionally add, remove or materially alter permanent property features in a manner that could mislead prospective buyers.
Virtual staging or substantial digital modifications will be identified or handled according to the client's instructions and applicable listing requirements.
Drone Photography
Aerial photography is subject to weather, location, airspace restrictions, safety considerations, equipment limitations and applicable Canadian aviation regulations.
Aerial services cannot be guaranteed where flight conditions or regulations prevent safe and lawful operation.
Portfolio & Promotional Use
Unless otherwise agreed in writing, David Vanclieaf Photographer may use photographs created during commissioned work for portfolio, website, social-media, advertising, competition and promotional purposes after the property is publicly listed or otherwise appropriate for publication.
Clients requiring confidentiality should discuss this before the photography session.
Limitation of Liability
To the extent permitted by applicable law, David Vanclieaf Photographer will not be responsible for indirect, incidental or consequential losses arising from use of the website, artwork, delayed delivery, photography services or licensed photographs.
Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.
Changes to These Terms
These Terms & Conditions may be updated periodically. The version published on this website at the applicable time will govern use of the website, subject to any separate written agreement with a client.
